Overview
On 19 February 2009, the Commission gave notice under sections 102 and 103 of the National Electricity Law (NEL) making the National Electricity Amendment (Confidentiality Arrangements in Respect of Information Required for Power System Studies) Rule 2009 No. 4 and its related Rule determination. The Rule commenced operation on 27 February 2009.
Background
On 8 April 2008, the Commission received a Rule change proposal from the NGF relating to the confidentiality arrangements in respect of information required for power system studies. The Rule change proposal would provide for:
- NEMMCO to disclose sufficient information to Registered Participants for planning and operational purposes while protecting the commercial value of information which it is only necessary to provide to NEMMCO; and
- network service providers (NSPs) to disclose to other NSPs sufficient information for planning and other purposes provided that consent is obtained from the person who provided the information.
On 8 May 2008, the Commission published a notice under section 95 of the NEL advising of its intention to commence the Rule change process and initial consultation on this Rule change proposal. First round Submissions closed on the 6 June 2008.
The Commission also published a notice under section 107 of the NEL on 12 August 2008, to extend the publication period of the draft Rule determination.
On 25 September 2008, the Commission published a notice under section 99 of the National Electricity Law (NEL) informing of the making of a draft Rule determination and draft Rule on the National Generator Forum’s (NGF) Rule change proposal. Subject to amendments implemented as a result of the Commission’s analysis or those raised in stakeholder submissions, the draft determination largely accepts the NGF Rule change proposal. Submissions to the draft determination closed on 7 November 2008.
The Commission published a notice under section 107 of the NEL on 18 December 2008, delaying publication of the final Rule and its associated determination.
On 22 January, the Commission published a notice under section 107A of the National Electricity Law (NEL), extending the period for publication of the final Rule and its associated determination on Confidentiality Arrangements in Respect of Information Required for Power System Studies by four weeks to allow additional consultation on a specific issue.
