Background

On 29 September 2008, NEMMCO wrote to the Commission proposing a Rule Change relating to NEMMCO’s information requirements for market ancillary services. The Rule Change proposal seeked to amend the National Electricity Rules (NER) to require NEMMCO to provide daily forecasts of the requirements for each type of market ancillary service, instead of weekly. NEMMCO contends that this amendment is consistent with NEMMCO’s current practice.

NEMMCO considered that the proposed Rule change is non-controversial as it is unlikely to have a significant effect on the National Electricity Market.

On 16 October 2008, the Commission published a notice under sections 95 and 96 of the National Electricity Law commencing initial consultation on this Rule change proposal and advising of its intention to expedite the Rule making process on the grounds that it is non-controversial, subject to written submissions.

The Commission considered this proposal to be non-controversial as it would have an insignificant effect on the market as a whole.

The Commission invited interested parties to provide submissions on the Rule change proposal by 13 November 2008. The Commission advised that any objections to the expedited Rule making process applying to this Rule change proposal had to be received by 30 October 2008.

On 27 November 2008, the Commission gave notice under sections 102 and 103 of the National Electricity Law (NEL) making the National Electricity Amendment (Preservation of Prudential Margin Through Call Notices) Rule 2008 No.14 and the corresponding Rule determination. This Rule was made under an expedited process under section 96 of the NEL. The Rule rectifies an anomaly in clause 3.3.11(a)(2) of the National Electricity Rules (Rules). The Rule commenced operation on 1 January 2009.
